Legal Separation
As an alternative to filing for dissolution of marriage, under Missouri law, a person can file for a legal separation. The major difference between a dissolution and legal separation is that there is no finding that the marriage between husband and wife is “irretrievably broken” which is necessary in order for the court to dissolve a marriage. A legal separation does not simply occur when a couple no longer resides together. It is a legal action, requiring a ruling from the court, as a final judgment.
